RESUMO: Desde muito tempo, a preocupação com os direitos e garantias fundamentais orienta a comunidade internacional a exigir dos países o cumprimento dos tratados e convenções ratificados. No caso brasileiro, as incontáveis violações mostradas pela mídia levaram a uma postura mais efetiva, com vistas a recuperar o prestígio internacional. Nesse cenário, através da Emenda Constitucional n°. 45, surge o Incidente de Deslocamento de Competência (IDC), um novo dispositivo processual que permite a federalização de processos que versarem sobre “grave violação aos direitos humanos”.
Contudo, os termos empregados pela Emenda são bastante genéricos, fato que certamente suscitará muitas dúvidas. Neste sentido, o presente artigo tem por escopo analisar o contexto em que a expressão direitos humanos é empregada, verificando sua precisão terminológica e algumas hipóteses de abrangência.
