TEORIA DA ARGUMENTAÇÃO JURÍDICA – ANÁLISE E CRÍTICA A CASO CONCRETO – PRINCÍPIOS DA PROPORCIONALIDADE E DA RAZOABILIDADE

RESUMO O maior desafio dado ao operador do direito constitui na melhor interpretação: quando advogado ou promotor, na busca dos interesses de seu cliente e da sociedade, respectivamente; quando magistrado, no melhor empenho de adequação objetivando um sentido de correção para atendimento da tutela jurisdicional. Os novos rumos dados aos princípios como fonte interpretativa acalorou debates na era pós-positivista sob o prisma de se efetivar justiça de forma justa, sempre levando em conta a transcedência da interpretação positivista e cujo teor tentamos estabelecer pelo presente estudo, mormente no estabelecimento dos conflitos dos institutos; regras e princípios. E a Teoria da Argumentação Jurídica de Robert Alexy bem se presta ao desiderato, sendo desta, efetivamente, retirada o embasamento de nosso estudo.

ABSTRACT This article analyzes that the best option for the law operators is the interpretation of the law, being the biggest obstacle for the lawyers or public prosecution service to guarantee the interest of its client and the society, respective. The judge, in the better adequate objectiving a purpose for de correction for satisfacation of the judicial tutelage. Emphasize how the new trend is to give force for the principles like fontain (source) interpretative unleash debates in the age positivist about prism to get justice, always considerate the transcend to the positivist interpretation which content intent to establish in this study, principal in the conflicts between institutes: rules and principles. Finally, we aim to focus how the Alexy´s Juridical theory of the argument as being the instrument to get our research.
