A CONVENÇÃO DA HAIA E A RESPONSABILIDADE CONSTITUCIONAL DO
ESTADO BRASILEIRO SIGNATÁRIO

[e-mail] RESUMO: Este artigo aborda a responsabilidade constitucional do estado brasileiro enquanto pessoa jurídica de direito internacional signatário de tratados e convenções internacionais, com enfoque especial na Convenção da Haia, que trata dos aspectos civis da subtração internacional de menores, e na sua recepção e efetiva aplicação no direito positivo interno à luz dos princípios constitucionais por ela adotados, quanto às garantias individuais e coletivas constitucionalmente concedidas aos brasileiros e aos estrangeiros residentes no País, entre eles a proteção do exercício do poder familiar e da pessoa do menor.

ABSTRACT: This article deals the constitutional responsibility of the Brazilian state while legal entity of international law signatory of treaties and international conventions, with special approach in the Convention of the Hague, which treats the civil aspects of the international child abduction, and in his reception and effective application in the brazilian positive internal law by the light of the constitutional bedrocks that for her was adopted, as for the individual and collective guarantees constitutionally granted to the Brazilians and to the foreigners residents in the Country, between them the protection of the exercise of the familiar power and the protection of the person of the juvenile.
