RESUMO

Este estudo tem como objetivo esclarecer, por meio de análise da doutrina e da jurisprudência, acerca da base de cálculo para o adicional de insalubridade, buscando entender as divergências atuais e a necessidade de estabelecer um parâmetro único de base de cálculo, a fim de que não seja prejudicado o trabalhador que laborar em condições insalubres e fizer jus ao recebimento do adicional. Iniciaremos com uma introdução acerca do instituto do adicional de insalubridade, após, faremos uma análise sobre quais empregados fazem jus ao recebimento, bem como em quais proporções, e finalizaremos trazendo os entendimentos atuais sobre a correta base de cálculo do adicional supra citado. Faremos uma análise da Constituição Federal bem como das súmulas e entendimentos jurisprudenciais existentes.

ABSTRACT

This study aims to clarify, by analysis of the doctrine and jurisprudence, about the basis for calculating the additional unsanitary, seeking to understand the current differences and the need for a single parameter in the calculation basis in order to not prejudicing the worker laboring in unsafe conditions and do justice to the receipt of additional. We start with an introduction about the institution of additional unsanitary after, do an analysis of which employees are entitled to receive, and in which proportions, and we conclude by bringing the current understanding on the proper basis for calculating the above mentioned additional.
