Resumo: O Direito de Família vem passando por notáveis mudanças. A família não mais se restringe ao pai, mãe e descendentes biológicos. Após a descoberta do DNA, os tribunais vêm enfrentando inúmeros questionamentos sobre a definição do que vem a ser pai. O que antes era puramente uma questão de ordem biológica hoje, a paternidade, requer principalmente laços afetivos. A partir da promulgação da Constituição Federal de 1988, velhas concepções foram postas de lado, abrindo espaço para um novo caminho, à paternidade socioafetiva ou “pai do coração”, caracterizando a família moderna unida pela afetividade. Neste artigo, procurar-se-á demonstrar que os “princípios da afetividade, da dignidade humana e do melhor interesse para a criança” permeiam a conduta e as decisões da magistratura, conectadas à realidade do mundo atual.

Abstract: The family law has comes notable’s changes. The family is no longer restricted to the father, mother and biological descendants. After the discovery of DNA, our courts will face a battle and countless questions about the definition of what is to be a father, what was once purely biological order today shows us that parenthood requires mainly ties of the heart. Since the promulgation of the Constitution of 1988, old ideas were put aside, making room for a new path to paternity socio "father of the heart" featuring a modern family united by affection. In this article we will see that the "principles of affection, dignity and the best interest for the child" should the conduct and decisions of the judiciary must be aware that the reality of the world.
