Atipicidade porte arma desmuniciada

PORTE ILEGAL DE ARMA DE FOGO DESMUNICIADA SERIA CASO DE ATIPICIDADE POR AUSÊNCIA LESIVA?

RESUMO: A Lei 10.826/2006, mas especificamente em seu artigo 14, coibiu o porte ilegal de arma de fogo, porém, o respectivo tipo penal não esclarece quanto a eventual prática do delito no caso de estar a arma desmuniciada. Assim, neste tema há dois posicionamentos: primeiro é de que não caracteriza o crime por inexistir lesão ou ameaça contra qualquer bem tutelado, o que torna a conduta atípica aplicando o princípio da lesividade ou da ofensividade. Outro entendimento é no sentido de apesar de desmuniciada não retira a ofensividade ao bem tutelado, uma vez que, apesar de estar incapaz para o disparo de projéteis, poderia causar ferimentos e ainda possui grande potencial de intimidação, sendo utilizada na facilitação de outros crimes, devendo ser aplicada a pena prevista – caracteriza crime de perigo abstrato.

ABSTRACT: the crime of illegal possession of arms, has been considered atypical when the firearm found no ammunition. Law 10.826/2006, but specifically in Article 14, shrunk illegal possession of a firearm, but the criminal does not specify its type as possible in case the offense of being a gun without ammunition. So there are two positions on this issue. First is that crime does not characterize the injury or due to lack well-protected against any threat, which makes the conduct atypical applying the principle of damage or offensiveness. There is another sense of understanding in spite of desmuniciada not deprive the offensiveness to the value in question, since, despite being incapable of firing bullets, it could cause injury and still has great potential for intimidation, being used in the facilitation of other crimes, should be applied to the penalty provided - is a crime of abstract danger.
