TUTELA ANTECIPADA INALDITA ALTERA PARTE: CONTITUCIONAL OU INCONSTITUCIONAL?

RESUMO
Este trabalho tem como finalidade examinar a concessão da tutela antecipada inaudita altera parte em relação aos princípios constitucionais do contraditório e ampla defesa. As decisões inaudita altera parte são aplicadas constantemente no mundo jurídico, pois elas garantem a entrega efetiva do bem em litigio. Porém, em compensação essas garantias constitucionais são diminuídas, pelo menos em algum momento. Essa situação divide opiniões, tendo em vista que a segurança jurídica é sacrificada, para que se alcance efetivamente a justiça, por meio da efetividade processual. Essa pesquisa pretende apresentar os pontos positivos e os negativos da concessão da tutela antecipada sem ser ouvida a parte contrária, esclarecendo o cabimento dessa medida, o momento correto para seu requerimento, e também seus efeitos concretos diante dos princípios do contraditório e da ampla defesa.

ABSTRACT

This paper aims to examine the unprecedented granting of injunctive relief in respect of changes to the constitutional principles of the contradictory and full defense . The unprecedented changes of decisions are applied consistently in the legal world , because they ensure the effective delivery of the goods in dispute . But in clearing these constitutional guarantees are diminished , at least at some point . This situation divides opinion , considering that legal security is sacrificed , so that they effectively reach justice through procedural effectiveness . This research aims to present the positives and the negatives of the injunctive relief without hearing the opposite party , clarifying the appropriateness of this measure , the correct time for your application , and also the actual effects on the principles of adversarial and legal defense .
