INTERPRETAÇÃO ANALÍTICA DO INSTITUTO JURÍDICO DA EVICÇÃO

RESUMO
O instituto jurídico da evicção surge quando o adquirente perde, total ou parcialmente, no âmbito de um processo judicial transitado em julgado, a coisa adiquirida em prol de um terceiro, por este provar e reconhecer que possui sobre o objeto litigioso direito anterior ao contrato. Portanto, são três os sujeitos da evicção: o evicto, adquirente que sofre a evicção; o alienante, responsável pela transferência do bem mediante contrato oneroso e pela indenização ao evicto; e o evictor, terceiro que promove a ação judicial reinvidicando a coisa em face do adquirente. Mesmo havendo a ocorrência dos pressupostos da evicção, esta não se configurará, caso o alienante comprove que a privação se deu por motivo de força maior, caso fortuito, roubo, furto, ou que o evicto tinha o pleno conhecimento da procedência ou autoria do objeto contratado. ABSTRACT
