Abstract
The article examines the phenomenon of passion crimes under the aspects that influence the occurrence, which are: juridical, criminal, and victimology aspects. It studies, beyond the fact (its general aspects and peculiar characteristics under the sphere of penal legislation), the murderer and the victim (personality and behaviors). The penal responsibility and the imputability will be also discussed. Considering that the biggest victims of passion crimes are the women, it is necessary a historical study of their condition since the period of the settling of Brazil until the current days, concluding that they still are victims of discrimination and violence, although all their achievements during this period. Another discussed question refers to the honor and its defense, thesis that, beside the defense of the dignity, was during decades used for the defense lawyers to obtain favorable results for its clients; nevertheless, under current conditions, it is considered unconstitutional for treating men and women differently. The article finishes with a brief study of the thesis regarding the accusation (Public Ministry) and the defense (defense lawyer) employed in cases of passion homicides.
