Direito racional e filosofia política em Kant

RESUMO: Não há continuidade entre a razão prática kantiana e a filosofia prática da tradição. Os princípios do pensamento tradicional estão fincados numa idéia objetiva de bem e justiça, numa constituição normativa do cosmo, na vontade de
Deus, natureza humana ou numa prudência que coteja valores e pondera interesses. Para Kant, em contrapartida, toda fundamentação de leis práticas soçobra à exceção daquela que ancora sobre regras e normas cuja obrigatoriedade tem origem na legislação da razão. Submetidos tão-somente às leis da mera razão, aos humanos não cabe mais o amparo moral do absolutismo teológico ou do teleologismo jusnaturalista, assim como lhes continua vedada a redução de sua atividade racional a fins intrínsecos, valores hierárquicos ou manobras instrumentais de destreza mental. O presente artigo expõe tópicos básicos da filosofia política kantiana à luz dos escritos tardios dos anos noventa.

ABSTRACT: There is no continuity between Kantian practical reason and the practical philosophy of tradition. The principles of traditional thought are based on an objective ideal of good and justice, in a normative construction of the chosmos, in God’s will, in human nature, or in a prudence that courts values and ponderates interests.
For Kant, on the other hand, all founding of practical laws bounces with the exception of that which is ancored on rules and norms whose obligatority has its origins in the legislation of reason. Submitted just and only to the laws of mere reason, it doiesn’t suit the humans the moral support of the theological absolutism nor the jusnaturalist teleologism anymore, as well as it is still denied to them the reduction of their racional activity for inner ends, hierarchical values nor instrumental maneuvers of mental destrity.
