PROVA ILÍCITA NO DIREITO PROCESSUAL PENAL E O PRINCÍPIO DA
PROPORCIONALIDADE

Resumo: O Direito Processual Penal é o ramo do direito que disciplina o conjunto de procedimentos que devem ser tomados quanto alguém incorre em crime e é acionado penalmente. Pelo princípio da presunção de inocência, de observância obrigatória, a acusação é quem possui o ônus de constituir provas robustas com o fito de buscar a verdade real. Contudo, o direito/dever à prova não é absoluto, tendo limites na
Constituição Federal e no próprio Código de Processo Penal, onde se veda a produção de provas ilícitas, consideradas as obtidas em violação a normas constitucionais ou infraconstitucionais. O presente artigo visa ponderar sobre o possível confronto entre a utilização das chamadas provas ilícitas com o princípio da proporcionalidade.

UNLAWFUL EVIDENCE IN CRIMINAL PROCEDURE LAW AND THE
PRINCIPLE OF PROPORTIONALITY
Abstract: The Criminal Procedural Law is the branch of law that governs the set of procedures that should be taken as someone incurs crime and criminal fires. The principle of presumption of innocence, of mandatory compliance, the prosecution is who has the burden to establish robust evidence with the aim of seeking the real truth. However, the right/duty to the test is not absolute, and limits on the Federal Constitution and the
Criminal Procedure Code itself, where it prohibits the production of illegal evidence, considered those obtained in violation of constitutional or infra-constitutional norms. This article aims to reflect on the possible confrontation between the use of so-called illegal evidence with the principle of proportionality.
