A COMUNICAÇÃO DOS BENS COM A CONCUBINA

RESUMO:

Este artigo visa refletir sobre a comunicação dos bens com a concubina, e a posição da família originária do casamento ou da união estável, no que tange aos bens patrimoniais adquiridos durante o relacionamento amoroso que começou com os vocábulos: “meu bem”,e ao termino do mesmo, o vocábulo “bem” passa ater o sentido de patrimônio e direitos adquirido ou não.Portanto, esta temática será analisada a luz do Direito da Família, Sucessão e Direito das Obrigações, sentença de 1º grau, decisão do Supremo Tribunal de Justiça e juntamente o Constitucional ao colocar em tela o princípio da Dignidade Humana, boa-fé, a igualdade perante a Lei ao equipá-la-á a União Estável e ter direito aos bens por ajudar a construir. This article deals with the communication of possessions with the concubine and the original position of marriage or the stable union as it concerns to the patrimonial possessions obtained during the couple relationship. Therefore the theme will be dealt in the light of the family, succession and obligation laws, first degree and Superior Tribunal de Justiçal sentences, and altogether the Constitutional in view of the Human Dgnity, plaindealing, equality before law as it makes it to the satable union and have right to the possessions obtained together.
