AUXÍLIO-RECLUSÃO COMO MEIO DE JUSTIÇA SOCIAL

RESUMO

Este trabalho tem como objetivo abordar alguns aspectos no que tange o benefício previdênciario do auxílio-reclusão, que é destinado dependentes do segurado de baixa renda, que por motivos diversos teve sua liberdade limitada por imposição da lei. Não podendo também ser estes dependentes, beneficiado por aposentadoria ou auxílio-doença, sendo seu pagamento de caráter familiar, buscando proteger o segurado e seus dependentes. Elencado no presente trabalho também os principios constituicionais garantidores do benefício, os quais são sustentados e positivados na Constituição Federal de 1988. Salientando também a importância social deste benefício, e sua contribuição perante as famílias que dele necessitam, para ter uma vida digna e longe da pobreza.

AID IMPRISONMENT AS A MEANS OF SOCIAL JUSTICE

ABSTRACT

This paper aims to address some aspects regarding the pension benefit of the aid-seclusion, which is dependent on the insured for the poor, who for various reasons had their freedom restricted by law enforcement. There may also be those dependent upon retirement benefit or sickness benefit, and payment of familiar character, seeking to protect the insured and their dependents. Part listed in this work also guarantors constituicionais principles of benefit, which are sustained and positivized the Federal Constitution of 1988. Stressing also the importance of this social benefit, and its contribution towards the families who need it, to have a decent life and away from poverty.
