Resumo: Este artigo tem por objetivo analisar os princípios constitucionais da legalidade e da eficiência no Estado atual. Objetiva-se nele demonstrar que referidos princípios devem se complementar e não se confrontar. Verifica-se, então, a utilidade em obter-se conhecimento das principais particularidades alusivas aos princípios em epígrafe, o que será feito através do método dedutivo, partindo-se da análise geral dos princípios constitucionais até se chegar à análise particular dos princípios em questão. Utilizar-se-á, para tanto, a técnica da pesquisa bibliográfica, para se concluir que não há como negar a importância do princípio da legalidade nem do princípio da eficiência, devendo ambos se complementar e não se contrapor. Só assim será alcançado o status almejado de um Estado Democrático de Direito.
Abstract: This article aims to review the constitutional principles of legality and efficiency in the state today. Objective is to demonstrate that these principles it should complement and not to confront. There is, then, the utility in obtaining it is aware of the main peculiarities alusivas to the above principles, which will be done through the deductive method, starting from the general analysis of constitutional principles until they reach the particular analysis of the principles in question . Use will be for both, the technique of bibliographic research, to conclude that there's no way to deny the importance of the principle of legality or the principle of efficiency, and both are complementary and not against. Only then will be achieved the status of a desired a democratic state.
