RESUMO: O presente estudo visa refletir sobre as questões ético-legais da enfermagem e aproximar o profissional das possíveis implicações legais advindas de sua conduta no trabalho. Ele é fruto de dúvidas suscitadas por estudantes de enfermagem a respeito do erro profissional, o que poderia ocorrer além das penalidades advindas do Código de Ética dos Profissionais de Enfermagem. Este fato, associado ao aumento da busca pelo direito, a partir da Constituição Federal de 1988, motivou a pesquisa bibliográfica sobre o tema em questão, abordando especificamente a responsabilidade civil desses profissionais.
É preciso estimular a reflexão sobre o assunto, possibilitando maiores discussões a respeito das situações de risco a que os profissionais de enfermagem estão sujeitos no seu cotidiano e as possíveis implicações legais delas decorrentes.

ABSTRACT: The aim of the present study is to think over ethical and legal questions concerning the nursing profession and to approach nurses to the possible legal implications of their professional behavior.
It has been originated from the doubts raised by nursing students about the professional errors and their possible consequences besides the Nursing Ethics Code’s penalties. These facts, together with the increasing seek for rights since the promulgation of the 1988 Federal Constitution, motivated a bibliographical research on the matter, emphasizing the civil responsibility of nursing professionals. A vast literature has been consulted, including articles, jurisprudences and Internet searches, but only the ten more important works have been selected.
