A TRAJETÓRIA DA ENTIDADE FAMILIAR E SUA REGULAMENTAÇÃO NO

RESUMO

Esse trabalho tem como objetivo o estudo da família, sua constituição e evolução no decorrer do tempo, e sua importância para a formação da sociedade. A Constituição Federal de 1988, em seu artigo 226 cita que a família tem especial proteção do Estado e traz em seu parágrafo
3º o reconhecimento da União estável entre homem e mulher como entidade familiar e sua facilitação para a conversão em casamento. O Direito de Família traz a igualdade de direitos aos formadores dessa entidade, e estão elencados no Direito Civil de 2002, que tratou do polêmico assunto referente ao casamento homo afetivo, que já era reconhecido como união estável, mas através da Resolução 175, facilitou sua conversão para o casamento.

RESUMEM OU ABSTRACT

This work aims to the study of the family, its constitution and evolution over time, and its importance for the formation of society. The 1988 Federal Constitution, in Article 226 mentions that the family has special protection of the state and brings in paragraph 3 the stable recognition of the Union between man and woman as a family entity and its facilitation for conversion it in marriage. The Family Law brings equal rights for forming this organization, and those listed in the Civil Law of 2002, which refers about the controversial issue relating to homoaffective marriage, which was already acknowledged as a stable union, and was The Resolution 175 that facilitated its conversion for the marriage.
