RESUMO

O presente artigo busca conceituar e identificar o fenômeno do assédio moral no ambiente de trabalho. Sendo certo que o tema em comento, na atualidade, é um dos mais controvertidos, uma vez que ainda não existe legislação nacional específica para tratar da matéria. Por sua vez a doutrina e a jurisprudência ainda não chegaram a um conceito pacífico e também não harmonizaram a sua definição, bem como, não existe uma forma de mensurar a indenização devida em caso da ocorrência de assédio moral. Por se tratar de discussão recente no meio jurídico pátrio, tendo aparecido nos nossos tribunais apenas nas últimas duas décadas, aproximadamente, ainda existe muita controvérsia para ser dirimida.

ABSTRACT

This article seeks to conceptualize and identify the phenomenon of bullying in the workplace. Whilst the subject under discussion, today, is one of the most controversial, since there is still no specific legislation to address the matter. In turn, the doctrine and jurisprudence have not come to a peaceful concept and does not harmonize its definition, and there is no way to measure the compensation payable in case of occurrence of bullying. Because this recent discussion in the legal parental rights, appearing in our courts only in the last two decades or so, there is still controversy to be resolved.
