O excesso de jornada como ofensa do direito ao lazer

RESUMO
O excesso de trabalho, todavia, vem provocando efeitos na sociedade, tais como acidentes, mortes e mutilações, atenuação das relações familiares, parcos convívios sociais. A dinâmica social e econômica reclama por ajustes constantes nas relações, e muito se fala na flexibilização das leis trabalhistas. A efetivação do direito social ao lazer depende, pois, da constatação fática da sua impossibilidade do gozo ante o caso concreto. O trabalho demonstra posições de doutrinadores e juristas frente ao artigo 62 da CLT ao excluir alguns empregados da proteção normal da jornada de trabalho. Tem como objetivo uma análise na visão dos doutrinadores quanto a inconstitucionalidade deste artigo, questionando se aqueles que necessitam de proteção ante a jornada exagerada receberão a tutela estatal; aqueles que dela não carecem não farão jus à intervenção judicial.

ABSTRACT
Too much work, however, has led to effects on society, such as accidents, deaths and mutilations, mitigation of family relations, weak social gatherings. The dynamic social and economic demands for constant adjustment in relations and much is said the easing of labor laws. The realization of the right social leisure therefore depends on the realization of its factual impossibility of enjoyment before the case. The work demonstrates positions of scholars and lawyers against the Article 62 of the Labor Code to exclude certain employees of the protection of normal working hours. Its objective analysis in the view of scholars on the unconstitutionality of this article, questioning whether those who need protection against over-the journey to receive state protection, and those that do not require it are not entitled to judicial intervention.
