A PSICOSE E O DELITO: A INIMPUTABILIDADE MENTAL NO DIREITO PENAL BRASILEIRO

RESUMO: O presente artigo irá tratar da questão dos inimputáveis mentais no Direito Penal Brasileiro, desde o histórico mundial da loucura, frisando os momentos mais importantes no contexto global. A partir disso, tenta trazer a questão das medidas de segurança, analisando seus principais critérios e pressupostos, de forma que possa ser formado a sua estruturação e que também possa ser explanado os requisitos utilizados para classificar um inimputável. Além disso, possui uma análise criteriosa das fortes falhas presentes nas mesmas, ressaltando principalmente as mudanças advindas da reforma psiquiátrica e os manicômios ainda existentes no Brasil com condições precárias. Por fim, é apresentado possíveis melhorias para todos os problemas existentes, mostrando que os transtornados mentais possuem sim, direito à cidadania e tratamento digno e que não se pode tratá-los de forma desumana e severa.

ABSTRACT : This article will address the issue of the mentally incompetent at the Brazilian Penal Law, from the crazy world history, emphasizing the most important moments in the global context. From there, try to bring the issue of safety measures, analyzing its main criteria and assumptions, so that it can be formed structuring and also the requirements used to classify an untouchable can be explained. Also, has a careful analysis of strong faults present in them, especially highlighting the changes arising from the psychiatric reform and the remaining asylums in Brazil with poor conditions.
