RESUMO Busca­se, neste trabalho, estudar a influência dos condicionamentos ideológicos no sistema jurídico, defendendo que ela, a ideologia, constitui­se em mecanismo cujo objetivo é escamotear toda a estrutura social, fazendo transparecer que as ideias independem das condições materiais de existência, sendo autônomas, portanto. Porém, a partir do método dialético de Marx veremos que, embora os sistemas sociais, em especial, o direito, não apareçam deste modo para a sociedade, ou seja, como instâncias que alienam os homens, isso é o que eles efetivamente fazem, e tal procedimento só não é perceptível por causa da ideologia, cuja principal função – tomando­se o seu conceito negativo – é a ocultação da realidade. ABSTRACT The aim of this paper is to examine the influence of ideological constraints in the judicial system, defending that ideology constitutes of mechanism in which the objective is to conceal the entire social structure, leading to the appearance that the ideas are independent of the material conditions of existence, and therefore autonomous. However, as of the dialectical method of Marx it is possible to observe that, although the social systems, in particular the law, may not appear in this way to society, i.e. as instances that alienate men, this is what in fact they do, and this procedure is unnoticeable merely due to ideology, which the main function – taking into account its negative concept – is to hide from reality.
