A importância da Medicina Legal no Direito do Trabalho

ABSTRACT:

This research paper seeks to make a correlation on the importance of Forensic Medicine regarding the Labor Law, serving as a benchmark for undergraduate students of law, as well as lay and enthusiasts of the subject, so that they can, clearly, concise and objective understanding and foster knowledge sympathetic to the issue addressed. Soon comes the need to contextualize the rules and procedures from the medical examiner and based on these, employs them under the Labor Law in order to achieve social justice and legal. We will see the importance of Infortunistica, ie, part of Legal Medicine who studies industrial accidents, occupational diseases and illnesses. There's no possibility of understanding the Forensic without an analysis, albeit quick, its relevance as legal and social science. We will see further, briefly and objectively the effects and issues of judicial expertise, highlighting the importance of the aforementioned skills and expert opinions for resolving disputes on the likes of the Labour Law. This article was prepared based on scientific articles, books, journals, monographs, completion of course work and various websites, so we recorded our debt and gratitude.

RELEVÂNCIA DA MEDICINA LEGAL

O Direito, especificamente o do Trabalho, bem como a Medicina se preocupam com a harmonia que deve existir com o ser humano. Os dois possuem um ponto em comum. O Direito se ocupa do ser humano integrado na sociedade, onde há leis, regras e ordenamentos que lhes ditam obrigações e lhes conferem direitos para que exista uma convivência ordeira, serena e pacífica. Já a medicina, cuida do homem provido de inteligência, de órgãos e aparelhos, que devem funcionar em harmonia e contento. Quando há a quebra do equilíbrio orgânico surgem as doenças. Entre os direitos protegidos temos a saúde (física e mental), a integridade física e a vida, mas esses direitos
