A condição dos animais no ordenamento jurídico brasileiro
Marcos Felipe Alonso de Souza Resumo: A finalidade do presente trabalho foi verificar a situação jurídica dos animais inseridos no ordenamento jurídico brasileiro e revelar a discussão do status jurídico dos animais. Seriam eles sujeitos ou objetos do direito? Foi feita uma pesquisa bibliográfica com o intuito de embasar a discussão proposta. Observou-se que apesar do sistema jurídico brasileiro considerar o animal como objeto do direito, a tutela jurídica destes seres-vivos é bastante relevante e coaduna-se com os princípios do Direito Ambiental e, de fato, com os Direitos Humanos. Embora a norma protetiva dos animais seja bastante evidente, a importância de se pensar na efetivação do Direito dos Animais e na manutenção da função ecológica da fauna ainda são ideologias que precisam ser construídas. Mas para isso, precisa-se investir na mudança dos atuais paradigmas e instaurar a concepção de novos direitos.

Abstract: The aim of this work was to verify the legal status of animal entered in the Brazilian legal system and to reveal the discussion about the legal status of animals. Are they subjects or objects of the rights? It was made a literature research to ratify the discussion. We observed that despite the Brazilian system consider the animal as an object of law, the legal protection of this living beings is quite relevant and consistent with the principles of the Environment Law and, in fact, with the Human Rights. Although the protective law of the wildlife is very clear, the importance of thinking about the effectiveness of the animal rights and the conservation of the wildlife ecological function still remaining ideologies that need to be built. But for this, it’s very important invest in changing of the current paradigms and introduce the conception of new rights.
