Abstract
The small family agriculture is considered one in which the labor of generating revenue is made up of living family members in the household. The maximum size of the small property in the state of São Paulo is 30 hectares. The Federal law 4771/1965 (the Forestry Code) considers that, regardless of the size of the property, the Permant Preservation Area can not be used for agricultural production, considered illegal any use of this area according to the current legislation . The objective of this study is to present, legal arguments according to the legislation the possibilities for the use of agroforestry system in these properties with the purpose of forest restoration permanent preservation areas. The São Paulo state Resolution 44/2008, agree to have agroforestry systems in the permanent preservation areas of small farms. Thus, the use of agroforestry in the areas of permanent preservation can contribute to forest recovery, as it enables the economic return and increases the social function of small property. However, there is a lack of information about the rights of smallholders and dissemination of appropriate technologies to a rational and sustainable use of natural resources.
