USO DO UNIFORME POR MILITAR NA CAMPANHA ELEITORAL

RESUMO

Devido à pertinência do tema no processo eleitoral, este trabalho foi realizado com o objetivo de contribuir para a discussão sobre a proibição do uso do uniforme por militar durante as campanhas eleitorais no Brasil. Observa-se que a referida proibição ainda é desrespeitada pelos candidatos militares, apesar de ser anterior ao regime militar de 1964. Na oportunidade, foi salientado através dos Regulamentos e
Estatutos dos Militares, nas diferentes esferas da federação, que há uma tendência de que essa proibição seja tratada apenas como transgressão disciplinar nas respectivas legislações militares e não encontra previsão na Constituição Federal ou no Código Eleitoral.

ABSTRACT

Due to the relevance of the topic in the electoral process, this study was conducted with the aim of contributing to the discussion on the prohibition of the use of the uniform by military during election campaigns in Brazil. It is observed that the prohibition is still disrespected by military candidates, although the previous military regime in 1964. On that occasion, it was stressed by the Statutes and Regulations of the Military in the different spheres of the federation, there is a tendency for this prohibition is only treated as a disciplinary offense in their military laws and can not find prediction in the Federal Constitution or the Electoral Code.
