O Tribunal Penal Internacional: funções, características e estrutura

Resumo: O Tribunal Penal Internacional é o resultado de um longo processo histórico em que se buscou punir os responsáveis pelos maiores crimes contra a humanidade, destacando-se o Tribunal de Nuremberg e os Tribunais Ad hoc da ONU. O Tribunal Penal Internacional, teve sua criação aprovada através do Estatuto de Roma em 1998, e iniciou seus trabalhos em julho de 2002. Ele possui competência para julgar quatro tipos de crimes: crimes contra a humanidade, crimes de genocídio, crimes de guerra e crimes de agressão. Seu princípio principal funda-se na complementariedade e subsidiariedade, possuindo como características o fato de ser permanente e internacional. Os 18 magistrados do Tribunal Penal Internacional são eleitos pela Assembleia Geral do Estatuto de Roma para exercerem mandatos de 9 anos sem direito a reeleição. As penas previstas serão de até 30 anos prisão, sendo aceitável, excepcionalmente a pena máxima de prisão perpetua[1].

Abstract: The International Criminal Court is the result of a long historical process in which it was sought to punish those responsible for the greatest crimes against humanity, especially in the Nuremberg Tribunal and the UN Ad Hoc Tribunals. The creation of the International Criminal Court was approved by the Rome Statute in 1998 and the court started its work in July 2002. It has jurisdiction over four types of crimes: crimes against humanity, crimes of genocide, war crimes and crimes of aggression. Its main principle is based on complementarity and subsidiarity and it possesses the characteristics of being a permanent and international court.
