THE NUREMBERG COURT: BETWEEN POSITIVISM AND NATURAL LAW.

RESUMO O presente visa traçar um estudo sobre a influência do positivismo e do jusnaturalismo para a concepção do Tribunal de Nuremberg e qual a sua importância para a tutela dos direitos humanos, culminando na sua universalização. Inicia-se do estudo das razões da guerra e da consequente quebra de paradigmas sobre os Direitos Humanos para a sua efetiva tutela diante das violações ocorridas durante a segunda grande guerra mundial. O estudo versará sobre a adoção do direito humanitário como um direito de Paz em detrimento de um conflito armado a partir do julgamento dos chamados criminosos de guerra perante o Tribunal de Nuremberg, o que resultou na quebra de barreiras para a efetivação dos Direitos Humanos. A pesquisa realizada utilizou-se do método indutivo e como técnica de pesquisa a bibliográfica e histórica.

ABSTRACT This aims to outline a study on the influence of natural law and positivism for the design of the Nuremberg Court and what is its importance to the protection of human rights, culminating in its universality. law as a right to peace at the expense of an armed conflict from the so-called trial of war criminals before the Nuremberg Court, wich resulted in breaking down the barriers to the realization of human rights. The search is performed using the inductive method and technique of the bibliographic and historical research.
