ESTADO DEMOCRATICO E CONSTITUI A BRASILEIRA

Resumo: A proposta nuclear do presente artigo reside na análise do paradigma democrático substancial e doprincípio da Justiça Social no âmbito do Estado Democrático de Direito instaurado na Democracia Brasileira com a Constituição Federal de 1988 (CF/88). Com a promulgação da Constituição Cidadã (CF/88), o cidadão tem procurado, cada vez mais, através dos instrumentos da democracia participativa, em especial, os mecanismos jurídicos de acesso à Jurisdição Constitucional, exigir dos poderes governamentais constituídos no Estado Democrático de Direito Brasileiro (Legislativo, Executivo e Judiciário) a concretização de Políticas Públicas Sociais que propiciem o acesso aos direitos humanos sociais que permitem a materialização das condições mínimas de existência compatíveis com a dignidade da pessoa humana. Abstract: The proposed core of this article lies in analyzing of the substantial democratic paradigm and of the Social Justice principle in the sphere of the Law Democratic State established in Brazilian Democracy with the Federal Constitution of the 1988 (CF/88). With the promulgation of the Citizen Constitution (CF/88), the citizen to have seek, more and more, through of the instruments of the Participate Democracy, in special, the Fundamentals Objectives of the Federal Republic of Brazil and of the lawful mechanisms of the access the Constitutional Jurisdiction, require of the Governmental Powers constituted in the Brazilian Democratic State of the Right (Legislative, Executive, Judiciary) the accomplishment of the Socials Publics Politics what to make possible the access of the Social Human Rights with permitted the realization of the minimal conditions of the existence compatible with the dignity of the human person.
