RESUMO

ABSTRACT

O presente trabalho investiga o tema central da obra de Konrad Hesse: a força normativa da constituição, cujas raízes estão na sua crítica às concepções de Ferdinand Lassalle acerca da definição de constituição (constituição escrita ou “pedaço de papel” e constituição real ou
“fatores reais do poder”). Hesse trabalha com os conceitos de constituição jurídica e
“vontade de constituição”, sendo que para ele o ordenamento constitucional é condicionado, mas também força condicionante da realidade fática e das relações de poder existentes no seio da sociedade. E é nessa interdependência que se tem tanto as possibilidades, quanto os limites da força normativa da constituição. Ao lado desse tema central, também se investiga outro tema não menos relevante, que é a temática da mutação constitucional.
