MODERNITY

Resumo: O artigo pretende apresentar as principais fases da história do direito medieval, com o intuito de vislumbrar heranças jurídico-políticas e desnaturalizar construções da modernidade. Para tanto, percorre-se a organização jurídica dos povos germânicos; o direito canônico e as formações jurídicas eclesiásticas; o direito feudal; o renascimento do direito romano e a formação das universidades e da cultura do ensino jurídico; os significados do medievo para a construção da modernidade; e, por fim, as conexões e genealogias da idade média na formação do direito penal moderno, a partir de uma contribuição de Michel Foucault. Palavras-chave: história do direito medieval, direito germânico, direito canônico, direito feudal, cultura jurídica e universidades, instituições modernas. Abstract: This article intends to present the main historical phases of Medieval Law, in order to highlight its political and juridical heritages and also denaturalize the constructions of modernity. For that matter, we are led through the juridical organization of the Germanic peoples, the canonic law and the formation of ecclesiastic law, the Feudal law, the rebirth of Roman law and the creation of universities and the establishment of the juridical teaching culture. We’re also guided through the meanings of the medieval for the construction of modernity and, at last, the connections and genealogies of Middle Ages in the formation of modern penal law, based on a contribution of Michel Foucault.
