LEIS TRABALHISTAS NA PERSPECTIVA DOS DIREITOS DAS MINORIAS.1

RESUMO

Este artigo objetiva discutir o Direito Trabalhista e a evolução das leis trabalhistas no campo das minorias. Trata-se de um tema amplo e possui, dentre outras funções, apontar os direitos do empregado e do empregador. As classes minoritárias veem conquistando notoriedade no âmbito jurídico, uma vez que, ao longo da história, tiveram seus direitos negados. Empregados domésticos e mulheres grávidas no mercado de trabalho ainda estão à margem no que diz respeito aos direitos trabalhistas, no entanto, é relevante ressaltar as conquistas dessas classes perante a justiça. Visto nessa perspectiva, o presente artigo fará uma ponte entre o presente e o passado das leis trabalhista para mostrar a evolução, funcionalidade das leis e as conquistas que foram alcançadas graças às lutas em prol da causa.

ABSTRACT

This article aims to discuss the Labour Law and the evolution of labor laws in the field of minorities. This is a broad topic and has, among other functions, pointing employee rights and employer. Minority classes see gaining notoriety in the legal sense, since, throughout history, have had their rights denied. Domestic workers and pregnant women in the labor market are still on the sidelines with regard to labor rights, however, it is important to highlight the achievements of these classes to justice. Seen in this perspective, this article will make a bridge between the present and the past of labor laws to show the evolution, functionality of the laws and the achievements that have been achieved thanks to the struggles for the cause.
