que o direito de superfície atende à necessidade prática de permitir a construção em solo alheio, acolhendo a propriedade de forma a cumprir o seu papel constitucional, a sua função social, bem como voltando-se para a preservação do meio ambiente, permitindo a transferência, gratuita ou onerosa, do direito de construir sem atingir o domínio. Apresenta-se como um novo e importante instituto, consagrando em ordem louvável a função social da propriedade e a ordem urbanística, disposto tanto no Código Civil quanto no Estatuto da Cidade, com mecanismos em seu bojo que permitem a utilização, por exemplo, do solo ou de prédios inacabados, a fim de promover o almejado bem-estar social e o planejamento urbano.

Abstract
Adduce the surface right takes care of the necessity practical to allow the other people's construction in ground, receiving the form property to fulfill its paper constitutional, the social function of the property, as well as turning toward the preservation of the environment, allowing the transference, gratuitous or onerous, of the right to construct without reaching the domain. It is presented as a new and important institute consecrating in sequence praiseworthy the social function of the property and order urbanistic, as much when made use in the Civil Code how much in the Statute of the City, with mechanisms in its bulge that allow the use, for example, of the ground or unfinished building, in order to promote the longed for one welfare state and urban
