O direito ambiental como direito fundamental à luz da Constituição de 1988

O DIREITO AMBIENTAL COMO DIREITO FUNDAMENTAL À LUZ DA CONSTITUIÇÃO DE 19881

RESUMO

O presente artigo vem com o intuito de analisar o Direito ao Meio Ambiente como Direito Fundamental, bem como a constitucionalização do Direito ao Meio Ambiente Natural. Entendendo - o como direito difuso com o fundamento formal do direito ambiental, por este se encontrar positivado constitucionalmente. Dentro do regime constitucional brasileiro, a inovação da Constituição Federal de 1988 em assegurar o meio ambiente como um bem público de uso comum tutelando-o juridicamente. Destaca-se, contudo, a faceta interdisciplinar do Direito Ambiental ocasionando a construção do saber ambiental transdisciplinar, por meio da multidisciplinariedade do meio ambiente através da seara normativa ambiental. Atrelado a isso, o diálogo pertinente do Direito Ambiental com as demais ramificações da Ciência Jurídica.

ABSTRACT
This article is aimed at analyzing the Right to the Environment as Fundamental Right and the Right to constitutionalization of Natural Environment. Understanding how the right-diffuse with the formal foundation of environmental law, for the latter is constitutionally positivado. Inside the Brazilian constitutional system, the innovation of the 1988 Federal Constitution to ensure the environment as a public good common use tutoring him legally. It is noteworthy, however, the interdisciplinary aspect of the Environmental Law causing the construction of transdisciplinary environmental knowledge, through multidisciplinary environment through harvest environmental regulations.
