RESUMO

ABSTRACT

Justifica a evolução do novo constitucionalismo e a ascensão dos direitos fundamentais a partir de três perspectivas: política, filosófica e teórica.
Aponta, na primeira, como fator principal, a relativização do conceito de soberania; na segunda, o desenvolvimento e superação dos ideais jusnaturalistas e juspositivistas; e na terceira, a superação do método subsuntivo e a legitimação da ponderação de interesses.
Pretende, assim, esclarecer o motivo da superação das chamadas “teorias clássicas dos direitos fundamentais” e a conseqüente consagração da “teoria integrativa” de tais direitos, cunhada a partir de uma visão metodológica distinta.

The author explains both the evolution of the new constitutionalism and the rise of fundamental rights under the political, philosophical and theoretical perspectives.
As to the first perspective, he points out the relativization of the sovereignty concept as a main issue ; as to the second one, the development and obsolescence of the jusnaturalist and juspositivist aims; and as to the third one, the obsolescence of the subsumptive method and the validation of the balancing of interests.
He intends to shed light upon the reason for the obsolescence of the so-called “classical theories of fundamental rights” and upon the consequent acknowledgment of the
“integrative theory” of such rights, created from a distinct methodological standpoint.
