NULIDADE E ANULABILIDADE DE VOTOS E DAS ELEIÇÕES: UMA RELEITURA PRINCIPIOLÓGICA

RESUMO

O artigo estudará, inicialmente, o histórico, os conceitos e os pressupostos relativos à democracia e às eleições no Brasil. Na sequência, examinará os fatos que acarretam a anulação ou nulidade de votos, das seções eleitorais e das eleições, tendo por base os princípios que norteiam a matéria - democracia, soberania popular, isonomia, lisura e moralidade eleitoral. Tratará, ainda, do efeito do voto natinulo e sua possibilidade de renovar o escrutínio. Por fim, examinará a vedação ao candidato que ensejou o cancelamento do pleito de participar das novas eleições.

ABSTRACT This study will initially analyze the history, concepts and assumptions relating to democracy and elections in Brazil. Following, it will examine the facts which lead to the annulment or nullity of votes, the polling stations, and the elections, based on the principles guiding the subject - democracy, popular sovereignty, equality, fairness and electoral morality. It will also deal with the effects of null vote and its ability to renew scrutiny. Finally, examine the sealing to the candidate which caused the cancellation of the election to participate in new elections.
