A INCONSTITUCIONALIDADE DO PLANO DIRETOR DE DESENVOLVIMENTO URBANO DA CIDADE DE SALVADOR, BASEADA NOS PRINCÍPIOS CONSTITUCIONAIS DO BEM-ESTAR, SOBERANIA POPULAR E FUNÇÃO SOCIAL.

RESUMO

A tentativa do presente trabalho consiste em demonstrar a inconstitucionalidade do Plano Diretor de Desenvolvimento Urbano de Salvador, aprovado pelo Poder Público Municipal, este considerado como o instrumento básico da Política Urbana do Município e tem por finalidade em regulamentar o planejamento e uso do solo urbano. Por Lei Federal é determinado que o plano diretor deva fomentar a justiça social, qualidade de vida e crescimento econômico para todos os sujeitos neles envolvidos. No entanto o PDDU do município de Salvador não preencheu os requisitos constitucionais para a elaboração e eficácia de tal norma, violando os princípios constitucionais do bem-estar, função social e soberania popular.

ABSTRACT

The attempt of this study is to demonstrate the unconstitutionality of the Master Plan for Urban Development in Salvador, approved by the municipal government, this considered as the basic tool of the Municipality and Urban Policy is intended to regulate planning and urban land use. By Federal Law is determined that the master plan should promote social justice, quality of life and economic growth for all subjects involved in them. However PDDU the municipality of Salvador did not meet the constitutional requirements for the design and effectiveness of such rule, violating the constitutional principles of welfare, social function and popular sovereignty.
