AXIOLOGIA, MORALIDADE E JUSTIÇA NA FORMAÇÃO DA NORMA JURÍDICA

Resumo: Parte da dogmática discute incansavelmente a respeito da existência de leis mais justas, levantam a questão moral que deve ser observada pelo Poder Legislativo no momento da elaboração das leis, colocando o homem como centro da relação jurídica sobrepondo-o aos interesses estatais. No Direito Positivo a lei deve ser única fonte do direito, ocorre que dentro desse sistema positivo estão presentes algumas leis incompatíveis com os valores, a moral e a justiça da sociedade. Os legisladores, de maneira subjetiva, elaboram os textos de leis a fim de regular as condutas intersubjetivas, porém é nítida a inobservância à alguns princípios bem como aos valores. Nesse sentido, pretende-se, com o presente estudo, demonstrar a influência axiológica no momento da elaboração da norma jurídica bem como ressaltar a moral e a justiça algumas vezes inobservadas.

Abstract: Part of the dogmatic tirelessly discuss the existence of fairer laws, raising the moral issue that should be observed by the Legislative Powers at the time of creating laws, positioning man as the center of the legal relationship superceding the State´s interests. In the Positive law the law should be the sole source of law, however within this positive system are present some laws which are incompatible with the values , morals and justice of society. Lawmakers, subjectively, elaborate laws to regulate interpersonal conduct, but it is clear the non-observance of some principles and values. In this sense, it is intended, with the present study, to demonstrate the axiological influence at the time of creation of the legal norms and to bring forward the occasional non-observance of specific moral and justice considerations.
