RESUMO
O presente artigo visa expor e analisar criticamente a situação atual do sistema carcerário brasileiro, as condições e o tratamento direcionado aos detentos e sua posterior reinserção na sociedade. Diante da situação atual deplorável, o tempo em cárcere – que deveria exercer função reeducativa e possibilitar a reinserção social do condenado – tornou-se algo vexatório e que macula a imagem do indivíduo perante a sociedade mesmo depois do cumprimento da pena. Com base em pesquisa bibliográfica e análise histórica das legislações, penas e do sistema carcerário, explora as características da reclusão no Brasil e o processo de reintegração do ex-detento na sociedade, expondo os fatores que levam a dificuldade de tal processo e contribuem para os altos índices de reincidência.

ABSTRACT
This article aims to expose and critically analyze the current situation of the Brazilian prison system, the conditions and the treatment given to detainees and their subsequent reintegration into society. Given the present deplorable situation, time in jail - should exercise reeducacional function and facilitate the social rehabilitation of sentenced - has become something shameful and that tarnishes the image of the individual to society even after sentence. Based on a literature survey and historical analysis of the laws, penalties and prison system, explores the characteristics of seclusion in Brazil and the reintegration of ex-detainee in society, exposing the factors that lead to the difficulty of this process and contribute to high rates of recidivism.
