RESUMO: O Direito Ambiental é uma disciplina é relativamente recente, cujo fator gerador encontra guarida na necessidade de conscientização social de que os recursos ambientais não são inesgotáveis. Tendo em vista este objetivo o legislador pátrio editou diversos instrumentos legislativos a fim de tutelar o meio ambiente, e a reserva legal, instituto inserido no ordenamento jurídico pelo Código Florestal, se mostrou relevante no combate ao desgaste do meio ambiente, haja vista que em observância às causas de extinção de espécimes pertencentes à vegetação nativa encontra seu nascedouro no desmatamento e desenvolvimento da agricultura, e sua regulamentação representou um freio nas atividades predatórias prejudiciais. A recomposição, inserida como foi objeto de disposição legal por parte do art. 44, I do Código Florestal, e foi cercada de todo um aparato institucional de fiscalização a fim de tornar efetivo o alcance da meta de ajustamento da conduta dos infratores aos preceitos legais.
